NOTICE AND CONSENT FOR COLLECTION, USE, AND RETENTION OF BIOMETRIC INFORMATION FOR ALCOHOL MONITORING SERVICES

KHN Solutions LLC, doing business as BACtrack ("BACtrack"), may collect, obtain, retain, capture, receive, store, create, use or otherwise acquire biometric identifiers, information which may qualify as biometric information, or any information based on biometric identifiers (collectively, "Biometric Data") when you use BACtrack mobile products and associated services (the "BACtrack Apps"). This Notice explains our practices with respect to that information, including the purposes for which it is collected or stored, the length of time for which it is retained, and the reasons for which we may disclose it to others, such as our service providers. How BACtrack Collects, Uses and Stores Biometric Data
The BACtrack Apps use facial detection features to detect the presence of individuals during the testing process, ensure test integrity, and reduce fraud. The BACtrack Apps use your device to complete the video verification process, but process and store certain Biometric Data necessary for the operation of the BACtrack Apps in our company systems. We use this Biometric Data in conjunction with the verification videos to ensure the integrity and performance of the BACtrack Apps. As we continue to enhance our Products and Services, we may use your Biometric Data with certain AI models and features, including in machine learning models. This helps us to quickly analyze large data sets to learn more about our customers and their uses of the Products and Services.
Biometric Data Retention: Unless otherwise permitted by law, information derived from the BACtrack Apps' facial identification features, including the number of individuals detected during the testing process, will be permanently deleted according to the table below.

How BACtrack Shares Biometric Data
In order to provide and improve the BACtrack Apps, we may share Biometric Data with our service providers, such as those that provide cloud, and communications services. Additionally, we may also share Biometric Data if required to do so by law; at the request of governmental authorities conducting an investigation or to a law enforcement agency for a law enforcement purpose in response to a warrant; to verify or enforce other applicable policies; to respond to an emergency; to effect an information transfer for which you have provided consent; or otherwise to protect the rights, property, safety, or security of third parties, and/or visitors using the BACtrack Apps.
Your Choices & Rights
Where required by law, before your Biometric Data is collected, used, or disclosed in connection with our products or services, we will first:
- Notify you, or your legally authorized representative, that Biometric Data will be collected, used, or otherwise processed, and
- Obtain informed written consent from you, or your legally authorized representative, for the collection, use, sharing, and disclosure of your Biometric Data.
You are not required to provide us with consent to use your Biometric Data; however, we will be unable to provide you with the full services of the BACtrack Apps if you decline to provide it. If you have previously consented to the use of your Biometric Data, you may revoke your consent at any time by contacting us at privacy@bactrack.com.
